Liability for Backyard Pools

Many homes with Pools do not comply with current Pool Fencing regulations and Council requirements (Pool Fencing Laws)

In the context of backyard Pools, last week a 61 year old man in a rural town became the first person in New South Wales to be charged with "Manslaughter" over a backyard drowning death after a child fell into his unfenced swimming pool and died.

Police alleged the man caused the the death of the 2 1/2 year old by failing to repair a broken perimeter fence, which acted as a Pool Barrier, for up to 12 months, and it remained unfixed the afternoon the little boy fell into it.

If you have a Pool or looking at Purchasing a Property with a Pool - ensure the fencing complies with Council asap. Having a small child of my own I could not imagine the pain and grief suffered by the Parents of the 2 1/2 year old boy.
